Niall Burke from Connolly, Ennis, is charged with an offence under the Harassment, Harmful Communications and Related Offences Act 2020

A Clare man who went to fight in Ukraine is now suffering from post-traumatic stress disorder (PTSD), a court has heard.

Niall Burke, aged 40, of Drumatehy, Connolly, Ennis, was not present when his case was called at Ennis District Court last week.

He is charged with threatening/grossly offensive communication under Section 4 of the Harassment, Harmful Communications and Related Offences Act 2020.

The court previously heard that the incident in question took place at the accused's home address on December 17, 2025.

No evidence regarding the specific details of the incident were outlined in court.

Garda Sergeant John Burke told the court that gardaí were awaiting directions from the Director of Public Prosecutions (DPP) before proceeding with the case.

Solicitor Daragh Hassett, representing the accused, said that his client had issues with his mental health after he spent time in Ukraine as a “freedom fighter”.

He said that Mr Burke needs help with his PTSD but has been frustrated by the lack of services available locally.

Mr Hassett added that his client is not a member of the Defence Forces and that they are unable to help him.

Judge Alec Gabbett told the court that PTSD is difficult to diagnose and requires very specialised treatment.

He questioned whether such treatment is available in County Clare or even in Ireland at all.

Judge Gabbett suggested that Mr Burke try searching the internet for places where treatment may be available.

The case was adjourned until April 22 for the preparation of a Probation Report. The judge said that this would give the accused “plenty of time to put his best foot forward”.
