Clare County Council refused planning permission for construction of 61 dwellings over wastewater connection issues

A developer has appealed a decision by Clare County Council to refuse planning permission for a major housing development in East Clare to An Bord Pleanála.

Sanford Properties Limited, based in Limerick city, have appealed the council's refusal to grant permission for a 61 dwelling development at a site on the Tulla Road, Teeronea, Kilkishen.

The proposed development would have seen the construction of a mix of 2 bed, 3 bed, 4 bed and 5 bed dwellings, both single and two storey.

The planning application also proposed the re-modelling of two existing derelict dwelling houses constructed on site to a doctor’s surgery with ancillary areas and two  2-bedroom apartments overhead at first floor level.

Clare County Council have refused permission for the development, a decision Sanford Properties have now appealed to An Bord Pleanála.

The council cited concerns over the development's proposed connection to the Kilkishen wastewater treatment plant, as correspondence Uisce Éireann states that such a connection "cannot be facilitated at this time".

The Kilkishen plant currently would not be able to support a development of this size, and it would be "premature by reference to existing deficiencies".

In their appeal to An Bord Pleanála, Sanford Properties stated their willingness to "pay for and install a temporary treatment system to cater for the majority of their own development, as Clare County Council/Irish Water have both zoned but not serviced the development land".

The appeal was lodged on February 21, and a decision is due from An Bord Pleanála by June 25, 2024.
