Bail is granted despite garda objection

A County Kildare man has appeared in court following the discovery of  €186,000 worth of cocaine.

Keith Russell, 39, whose address was given as 6 Grattan Park, Derrinturn, is being prosecuted for having cocaine for sale or supply at Grattan Park, Dreenane, Derrinturn, on May 2.

He came before a special sitting of Naas District Court today (May 4).

Gda Michelle Murphy said the defendant made no reply when charged.

She also said that when the address was searched under warrant the drug was found near a back garden wall.

She also said that a cocaine press was found in  a shed and it had white residue.

Cross examined by barrister Aishling Murphy, the garda said the drugs were found at the back of the property near a wall and she believed this was only accessible by occupants of the defendant’s address.

She did not believe that it was accessible by the occupants of other houses and added the defendant has been living there for six months.

Sgt Brian Jacob objected to bail.

Ms Murphy told the court the defendant could provide an address in Dublin in support of a bail application and she added he has sleep apnea and requires a machine to help him sleep.

She said he had limited means but he could produce a cash lodgement as part of a bail application.

She said the defendant, who receives a disability payment, “is not involved in this' ' and is only living at that address for a matter of months.

Judge William Aylmer granted bail on a bond of €1,500. He said the court is satisfied he is not a flight risk.

A number of conditions were imposed including that the defendant reside at his address, sing on three times a week at Leixlip garda station, observe a curfew between 10pm and 6am and provide a mobile phone number and be available on a 24 hour seven day week basis.

The judge adjourned the matter to October 3.
