Kildare duo accused of attempted robbery sent forward for trial
ALLEGED JOINT ENTERPRISE
A court case involving two suspects accused attempting to rob two takeaways has been re-entered and sent forward for trial.
Previously, the case against Stefan O’Leary, 21, with an address listed at 25 Roseberry Court in Newbridge, was struck-out on Thursday, June 22 last at Naas District Court.
However, the case was brought back before the court on Thursday, July 13, where Mr O’Leary appeared alongside his co-accused Patrick Behan, 41, with an address listed as 3407 Bishopsland in Kildare town.
The court was told back in March that on March 27 last, the duo allegedly attempted to carry out robberies at two Newbridge takeaway food premises to feed a drug habit
Judge Desmond Zaidan was also told by gardaí that Mr Behan faced an additional charge of criminal damage.
It was heard that on July 4 last, he allegedly became involved in an argument with gardaí at a garda station.
This allegedly prompted Mr Behan to throw a rock at a nearby car in the station’s parking lot, causing around €1,100 worth of damage to the car.
"I assume you mean he picked up a rock, and not the actor 'The Rock'?" Judge Zaidan jokingly remarked to gardaí.
It was also claimed that he has a Stanley blade in his possession at the time of the alleged offence.
After a book of evidence was served on both Mr Behan and Mr O’Leary by gardaí, Judge Zaidan sent both men forward for trial to the present sittings on Naas Circuit Criminal Court, which commenced on June 20.
