CONVICTED

A three-month custodial sentence was imposed on a North Kildare man who was caught by gardaí with a silver hammer hidden in his trousers.

Judge Desmond Zaidan made the decision at Naas District Court on Thursday, December 7 last, in the case of Thomas Kiely, with an address given as 373 River Forest, Leixlip, but who is currently serving a custodial sentence on other matters.

The 42-year-old appeared before the judge via video-link.

Garda Sergeant Mary Meade told Judge Zaidan that on May 18, 2022, Mr Kiely was spotted by gardaí sitting on the side of a road located at Boherhole Cross.

Sgt Meade added that Mr Kiely has 60 previous convictions.

When Judge Zaidan asked her if any of these were for violent offences, Sgt Meade replied that two of these convictions were for production of an article (referring to a tool that could potentially be used weapon), and three of them were for possession of knives.

Defending solicitor Tim Kennelly said that his client works in construction, hence why he had the hammer on his person at the time of the incident.

He further said that his client’s convictions for the articles and knives 'occurred in his younger years.'

The court was told that Mr Kiely was serving a 12-month custodial sentence, and is due for release in August of 2024.

After consideration, Judge Zaidan decided to impose a three-month sentence on Mr Kiely, which will run into his current sentence.

The judge told Mr Kiely: "You have Mr Kennelly to thank for my verdict."
