Claim

A woman claimed at Naas District Court that her partner had slashed the tyres of the car.

The woman was seeking protection at a family law hearing.

She said her partner had been arrested.

The court also heard an allegation that the man, who was not present and was not represented, tried to “kick in a door”.

She alleged that he hit her over the head with a torch and she had heart surgery.

She also claimed that he moved her arm  up which meant that a device was moving.

“I was in fear of my life,” she stated.

She also claimed that a couple of nights later he returned to the dwelling at about 2AM.

It was claimed he tried to choke her and one of the children rang the gardaí, but he said he was entitled to come into the house.

It was further claimed that he had been in contact with her family claiming she is having an affair and he kicked in a side door and a shed door.

Cross examined by solicitor David Powderly she said the man is a great dad to their children but she did not believe he contacted family members in a bid to “rectify the situation.”

She said she had been “verbally abused for years” and “accused of things for hears.”

Her husband said he had seen explicit pictures on her phone and she abused him when he asked her about these.

He said he woke her to ask her about the pictures and started to abuse him. He said he was angry but she had called him every name.

He said he threw the phone on the couch and followed her up the stairs saying “you’re going to tell me who it is.”

“I sat on the bed and was angry and upset,” he added.

He said she scraped him and he never tried to choke her.

There is no reason for her to be in fear of him, he said.

He admitted slashing the tyres because he said it was not safe for her to be driving the children because she is not insured because she cannot wear a seat belt.

He denied going to her bedroom and said the torch fell when he grabbed the phone.

He said the torch couldn’t have fallen on her head and added she bruises because of medical treatment she’s receiving.

Judge Miriam Walsh granted a barring order for a year.
