Kildare court: Probation and disqualification imposed by judge

MAYNOOTH
A probation report was ordered for a man who spat on a garda twice.
Judge Michéle Finan made the order at Naas District Court on Thursday, February 9, in relation to one Declan Duffy, with an address given as Meenbanad, Bartonport, County Donegal.
Gardaí said that the 25-year-old was stopped by gardaí for driving while intoxicated at Carton Demesne Road in Maynooth on April 6 last.
It was said that Mr Duffy had grabbed one of the gardaí and spat on him twice.
In addition, gardaí said that he refused to provide a urine sample to gardaí when asked to do so.
DEFENCE
Defending solicitor Tim Kennelly said his client has no previous convictions, and was apologetic over his behaviour on the day in question.
He added that while his client previously had alcohol issues, he has since addressed them by attending treatment.
In response, presiding Judge Michele Finan said that while she appreciated Mr Duffy's proactive approach in seeking treatment, she added: "No garda, or anyone, should be treated this way.
"I take this matter exceptionally seriously."
The judge ordered a report for Mr Duffy, which is due on December 21.
She granted bail for Mr Duffy until this date.
Judge Finan also imposed a four-year driving disqualification on him for the refusal offence.
She further imposed a two-year driving DQ for driving with no insurance, which will run concurrent with the first DQ.
