Accused of burglary and assault in Laois

A man appeared in court accused of assault, burglary and criminal damage in Portarlington.
Dylin Lawless, 25, with an address at 379 Market Mews, Maryborough Village, Portlaoise is accused of burglary, assault causing harm and criminal damage at Droughill Lawns, Portarlington on July 19 last. He is also accused of possession of cannabis at his address in Portlaoise on July 20 last.
Solicitor Josephine Fitzpatrick said the case against her client had been marked peremptory against the State on the last occasion. She said it was adjourned for directions from the DPP on how the case was to progress.
“We don’t have directions as of now,” said Garda Sergeant JJ Kirby.
Ms Fitzpatrick said her client was in custody on the charges and the case had been marked peremptory against the State on the last occasion. She asked that it be struck out.
“The accused enjoys the presumption of innocence on all matters,” she said.
She asked that the case be struck out and said there was nothing stopping the gardai re-arresting the man if and when directions are received.
Judge Andrew Cody said he was not prepared to strike out the matter.
“This court on October 19 for the purpose of reconsidering bail. State to produce,” he said.
Ms Fitzpatrick objected and again stated that the case had been marked peremptory.
“It is a rather complex case. There are a number of charges,” said Sgt Kirby.
Judge Cody adjourned the matter to Portlaoise District Court on October 19 for bail to be considered.
