Laois Judge says court better off reading Enid Blyton than continuing with solictor's explanation

Judge Andrew Cody made the comments at Portlaoise District Court
A judge suggested a court would be better off reading Enid Blyton rather than continuing with a solicitor’s story about an uninsured driver.
Brian Fassnidge (47) of 3129 Senview Heights, Newbridge, Co Kildare appeared before Portlaoise District Court accused of giving a false name when stopped driving without insurance and licence on the Abbeyleix Road in Portlaoise on July 6, 2024.
Garda Ger O’Mahoney said the defendant had been stopped for using a mobile phone while driving a 161D registered white Fiat 500. He initially claimed his name was Brian Rutledge however enquiries revealed his true identity and that he was disqualified from driving and had 14 previous convictions.
Solicitor Philip Meagher admitted his client’s history “leaves a lot to be desired”. He said the man was self-employed in the motor trade.
Mr Meagher said the man had travelled to Portlaoise with his partner to buy a pet for his partner’s child who was due to have a birthday. He said the woman was not used to driving in Portlaoise and so the man took over.
Judge Andrew Cody branded the story “poppycock” and said the court would do better to “read Enid Blyton or something”.
Mr Meagher said his client was “very, very apologetic” and realised “how foolish he was” on the day.
Judge Cody noted the man had 14 previous convictions and this offence would be his second for no insurance.
He imposed a six month sentence and suspended the final three months for two years. He also fined the man €750 and disqualified him from driving for seven years. Judge Cody fixed recognisance in case of appeal.
The defendant appealed the sentence before the court sitting had ended.
