A man found urinating on the main road told gardai the public toilets were out of order.

Gordon Bergin, 47, with an address at The Lodge, Danganroe, Castletown admitted an offence of disorderly conduct at Stillbrook, Mountrath on November 11, 2021.

Garda Sergeant JJ Kirby said the accused was “observed urinating on the Main Road” and although he was issued a fine, it went unpaid. He said the man has 36 previous convictions.

Solicitor Josephine Fitzpatrick noted it was a year and a half since the incident occurred.

“He apologised to the garda for his behaviour on the day. The public toilets nearby were inoperable at the time,” she said.

“He was just caught short,” she added.

Judge Andrew Cody fined the man €500. He fixed recognisance in case of appeal and granted legal aid.
