A Judge refused to strike out an assault charge at a sitting of Portlaoise District Court.

Wayne O’Donoghue, 22, of 7 Old Knockmay Road, Portlaoise is accused of assault causing harm at his address on June 19 last.

The case was adjourned for directions from the DPP and a decision on jurisdiction.

Garda Sergeant JJ Kirby said “the directions are we don’t have directions yet, judge.”

Solicitor Michael Byrne asked Judge Nicola Andrews to consider striking out the charge due to the delay in directions.

Sgt Kirby told Judge Andrews that it was a serious allegation. He said a medical report was awaited.

Sgt Kirby said it is alleged the injured party received a cut to the top right hand side of her head.

“She was allegedly kicked in the stomach and hit on the head with a cup,” Sgt Kirby explained.

Judge Andrews said she wouldn’t strike the matter out but would instead mark it peremptory and against the State. She said the matter was going on too long.

The case was adjourned back to Portlaoise District Court on February 12.
