A MAN who was smoking in his room in the Tullamore Court Hotel, fled when he was asked to stop.

On February, 14, 2023, Josh Neary (23) Chancery Park Road, Tullamore, and another man were smoking in the room. When they were asked to stop they fled.

As a result of the smoking, the hotel room couldn't be used until it was deep cleaned at a cost of €140.

Mr Neary had a number of previous convictions including violent disorder, possession of articles, damaging property and theft.

Solicitor Patrick Martin said his client was homeless in Tullamore. He had €140 with him in court.

''Had he nothing better to do on Valentine's Night but sit in a room in Tullamore smoking?'' asked Judge Cody. Mr Martin said his client has mental health issues.

The co-accused in the case had already made a contribution, the court heard.

Judge Cody noted that Mr Neary had a ''significant number'' of previous convictions. He fined the defendant €200 and gave him six months to pay.

An application for legal aid was granted.
