A DISTRICT Court judge has refused to hear a case where a man allegedly assaulted another man, causing him harm.

Judge Andrew Cody refused jurisdiction after hearing a summary of the alleged facts in the prosecution of Patrick Kane (28), Arden View, Tullamore.

It is alleged that Mr Kane assaulted Josh Mills on November 15 last year at Hayes Cross, Tullamore and that a kick to the head resulted in a chipped bone.

Donal Farrelly, defending solicitor, said Mr Kane will be pleading not guilty.

Sergeant James O'Sullivan told the court the DPP had directed that the matter could be disposed of summarily in the District Court but Judge Cody adjourned the case to February 15 next year for the DPP to consider trial by indictment instead.
