OFFALY County Council brought a case against a Tullamore man for committing a waste offence, during last week's sitting of Tullamore District Court.

Andrew Gonoude, Clara Road, Tullamore, was charged with the following: “that you the Accused your servant or agent having been served with a notice dated 22 March 2023 pursuant to S55 of Waste Management Act 1996 did on the or about 5 April 2023 fail to comply with the terms of that notice in respect of Clara Road, Tullamore, County Offaly contrary to S10 and Section S55(8) of the Waste Management Act 1996 as amended by S22 of the Protection of the Environment Act 2003.”

The defending solicitor Patrick Martin told the court that the waste problem has been dealt with by his client.

“The waste was domestic waste located at his own property, which he hadn't dealt with; but he has now.”

He added that his client is not in the best of health and is on social welfare.

Judge Andrew Cody convicted and sentenced to six months imprisonment, suspending for two years.

He also ordered that Mr Gonoude engage a bin service provider on a regular basis.
