Derry Court: Man released on bail scored 'an own goal' and called police four hours later

A man who was released on bail on Wednesday at 12.30pm was found to have breached it some 4 hours later after he scored 'an own goal' and called the police.

Michael McMahon (31) of Clon Elagh in Derry had been released on bail on condition he did not take alcohol on domestic abuse charges.

The court heard that the alleged victim in the case claimed that the defendant had shouted 'obnoxious remarks' at her from an upstairs window.

When police arrived after they were called by McMahon because he said the woman had approached him he was found to have an alcohol on breath reading of 63mgs with the driving limit being 35mgs.

A police officer said they had no confidence that McMahon would abide by bail conditions.

Defence solicitor Paddy MacDermott said his client would say the woman called at a house beside where he lived despite claiming she was afraid of McMahon.

As regards the bail breach Mr MacDermott said that his client had been in custody for a day and a half and after been released had called to a friend and drank a can of WKD and a beer.

He said McMahon had complied with his obligations to call police when he saw the woman in his street.

Deputy District Judge Philip Mateer said one of McMahon's conditions had been no alcohol but he said he would give him one chance.

McMahon was released on bail to appear again on March 9.
