District Judge Barney McElholm has issued a warning that the preliminary enquiry in the case of a man charged with the murder of Katie Simpson must go ahead on April 5.
Jonathan Cresswell (35) of Briar Hill Gardens in Greysteel faces one charge of the murder of Katie Simpson on August 3 2020.
Initially it had been thought that Ms Simpson had committed suicide but it later became a murder inquiry.
A date had been fixed for the preliminary enquiry to take place last week but that did not happen.
At this week's hearing a prosecutor told the court that one of the delays was due to the lack of an analyst's report on the mobile phone data which was available in raw form at the minute.
Defence counsel Eoghan Devlin said that this development was a 'bit disappointing' as the investigating officer had said at the first appearance that it would only take 4 weeks to prepare a file in the case.
Judge McElholm said that he was issuing what is known as a McAleenan warning which means that the PE must go ahead on April 5 or else the case could be thrown out.
Papers in the case are due to be served by March 29 and the PE is scheduled for April 5.
