Derry Magistrate's Court
A man currently on bail with a curfew condition 'nipped out to get cigarettes' and had the misfortune to get into an altercation with a drunk Derry Magistrate's Court heard today.
Brian Boyle (35) of Clarendon Street in Derry is currently on bail for a series of offences including assault occasioning actual bodily harm.
The court was told that on February 28 and incident was captured on CCTV showing Boyle involved in an altercation with a man who it was believed has a knife.
Police attended and it was discovered that Boyle was in breach of his curfew and he was arrested.
Defence solicitor Seamus Quigley said that the incident occurred about 100 yards from his home address.

He said the defendant thought he could go out and get cigarettes and get back without being detected.
The solicitor said that he ran into a drunk man and there was a altercation and Boyle was punched by thus man.
Police attended and Boyle was arrested for breaching his curfew.
Boyle was re-released on the same bail conditions and will appear again on March 12.
