Child knocked unconscious in van crash awarded over €20,000

The child, who was unrestrained in the rear of a van, was awarded the sum at Letterkenny Circuit Court this week

A child knocked unconscious in a road traffic accident while in the back of a van was awarded €20,950 at Letterkenny Circuit Court this week.

The child, who was in care at the time, cannot be named.

The court was told by Patricia McCallum BL that the accident happened when the child was unrestrained in the rear of a van.

The court was told the child was rendered unconscious and was kept in hospital for 48 hours.

The bruising lasted two to three weeks, Ms McCallum said.

Ms McCallum described the €20,950 as a very good offer ‘at the highest limit’.

Judge John Aylmer agreed and said €950 special damages should be paid out within three weeks and awarded Ms McCallum her costs.
