New houses at Ballyraine can only be sold as permanent homes

Donegal County Council has granted planning permission for a development of six houses at Cruach Na Cille, Ballyraine, Letterkenny.

However the planning authority has attached 23 conditions to the development, plans for which were submitted by Teresa Tinney in lieu of a previously granted layout. 

One of the conditions is that the houses shall be used as ‘permanent houses and apartments only’ and shall not be used for the purposes of holiday homes. Such holiday home use can only be commenced if authorised by a separate grant of permission. First purchasers of the properties may only be individuals, and not corporate entities. 

Among the other conditions laid out in the notification of decision are that all connections to utilities and other infrastructural work are completed prior to first occupation. Work must also be fully completed on communal gardens and green spaces will be completed before residents can move in.

At least 15 semi-mature broadleaf trees native to the area must be planted within the site boundaries within the first planting season, and any trees that die within three years are to be replaced. Any healthy trees, shrubs and hedgerow within the development must be retained. The developer is also required to plant at least one broadleaf tree in the front garden of each dwelling.

Further conditions apply to the completions of roadways, central pathways and footpaths, boundary fences, ducting access, play areas and lighting. 

A number of conditions relating to the construction phase have also been imposed. 

Hours of construction are limited to 8am to 6pm Monday to Friday, and 8.30am to 3pm on Saturdays, with no construction work on Sundays and bank holidays.  

A detailed Construction Management Plant must be submitted prior to the commencement of development.
