Uninsured driver in Ardara did not have child restrained, court hears

The man, who appeared before Glenties District Court, was handed a two-year driving disqualification

An uninsured driver has been put off the road for two years after being caught behind the wheel in Ardara.

A child was not restrained in the rear seat of the car being driven by Felipe De Albuquerque Rosa and a tyre was excessively worn, Glenties District Court heard.

The defendant, a 35-year-old with an address at Ard na Greine, Ardara, was stopped by gardai at Hillhead, Ardara.

The grey Vauxhall Insignia he was driving had an excessively worn tyre and gardai noticed that a child in the rear seat was not restrained.

Fixed charge penalty notices were issued in respect of these matters.

The insurance on the vehicle had expired and the accused man chose to produce his at Ardara garda station within ten days. However, he did not produce any documents.

Inspector Rosaleen Logue confirmed that he had no previous convictions.

De Albuquerque Rosa was not present in court, but Judge Ciaran Liddy found the facts proven.

For driving without insurance, De Albuquerque Rosa was disqualified from driving for two years. He was also fined €200 and given six months to pay.

A charge of failing to produce insurance was marked as taken into consideration.
