McCafferty's, Donegal Town is hoping to have its late licence in place in the coming week
At the request of the applicant, the monthly dance licence application McCafferty’s Bar in Donegal Town has been further adjourned at Sligo District Court.
The applicants asked via local solicitor Mark Mullaney acting as agent for Sweeney McHugh Solicitors for a further adjournment. This took place at Sligo District Court on Thursday, November 28. It followed a similar application the previous week.
Mr Mullaney asked on behalf of Sweeney McHugh Solicitors, that the matter be listed for the district court sitting in Donegal Town on Wednesday, December 4.
The applicants have been requesting these short adjournments to allow matters to be finalised with the fire officer.
The application for the Monthly Dance Licence which would allow late opening at weekends was lodged at Ballyshannon District Court on Friday, November 15.
Brendan Maxwell as nominee of Fanad Head Limited of McCafferty’s Bar, The Diamond, Donegal Town applied for a Monthly Dance Licence at McCafferty’s Bar, Donegal Town, to run from November 15 to December 16 for public dancing from 12.30pm to 2.30am.
This followed recent adjournments of an annual dance licence application, and an application for special exemptions for late opening at weekends during the month of November.
Judge Sandra Murphy said at the annual licencing court in Donegal Town in November that she could not grant the licence , while there were outstanding garda and fire officer objections. Nor, she said, could she grant the requested special exemptions which would have allowed temporary late opening.
Fire officer Conor McShane outlined a previous court sitting that annual certificates remained outstanding, and that works carried out in the absence of a Fire Safety Certificate in 2022 needed to be regularised.
