Man charged with driving in manner causing ‘risk of death or serious harm’

The defendant is also facing a charge of assault causing harm, and possession of a knife

A man has been remanded on bail for charges including assault causing harm, having a knife in the course of the assault, and driving in a manner which could have caused death or serious harm.

Charlie McDonagh, 43, with addresses listed as Oak Lane, Billericay, Essex, London, and 42 Silver Woods, Ballybofey, was before Ballyshannon District Court on Friday, December 20.

He is charged that on May 6, 2023  TJ Hughes Service Station, Cloghore, Ballyshannon, McDonagh assaulted Patrick Joseph Ward causing him harm. 

New charges were brought ahead of Friday’s court sitting. McDonagh is charged that on May 6, 2023 at Straddle Service Station, Cloghore, Ballyshannon, he intentionally or recklessly engaged in driving a motorcar in a manner which created a substantial risk of death or serious harm to another. He is further charged that on the same date, he had possession of a knife intended to unlawfully assault Patrick Joseph Ward.

Detective Garda Ciaran O’Brien told the court that McDonagh made no reply when charged.

Inspector Anthony Coyle outlined that the Director of Public Prosecutions consented to the accused being sent forward for trial, or for sentence on assigned plea, on the three charges.

Judge Sandra Murphy remanded McDonagh on continuing bail to Ballyshannon District Court on February 21 for service of the  book of evidence. 

McDonagh is also charged that on December 10, 2020 at Mooney Boats, Shore Road, Killybegs, he induced by deception Antoine O’Hara to charge €60 for a bilge pump.

Judge Murphy remanded McDonagh on continuing bail to February 21 for plea on that matter. 

She extended legal aid to solicitor Morgan Coleman on the new charges.
