A Donegal County Councillor is to be served with a book of evidence after he was charged with allegedly stealing a mobile phone from another councillor.
The case against Councillor Frank McBrearty was mentioned at Letterkenny District Court this week.
The book of evidence was due to be served this week, but the court was told that the time for the service had been extended by consent.
The book will now be served to Councillor McBrearty on September 22nd.
The alleged incident took place at the Aura Leisure Centre, Sallaghrane, Letterkenny, on July 11, 2022.
The charges stem from an alleged incident that occurred during a special meeting of Donegal County Council. He is charged with stealing property, to wit, a Samsung S21 Ultra Mobile phone valued at €1,000, the property of Gary Doherty.
The offence is contrary to Section 4 of the Criminal Justice (Theft and Fraud Offences) Act 2001. Councillor McBrearty, a 56-year-old of Tullyvinney, Raphoe, was not in court for the short mention of the case.
Solicitor Michael Staines was present in court to keep a watching brief for Donegal County Council.
Councillor McBrearty was not present, but was represented by his solicitor, Mr Patsy Gallagher.
