Ballyshannon Courthouse
A 38-year-old man has been sent forward for trial on five charges relating to alleged possession of drugs, and possession for sale or supply.
Stephen Heraty of Finner, Ballyshannon, was before Ballyshannon District Court on Friday, September 5. It is alleged that on September 17, 2022 at Rampart Lane, Finner, Ballyshannon, he was in possession of diamorphine for the purpose of sale or supply.
On the same occasion, he is alleged to have been in possession of cocaine for the purpose of sale or supply. Both offences are contrary to Section 15 of the Misuse of Drugs Act 1977 and Contrary to Section 27 (3) of the Misuse of Drugs Act 1977 as substituted by Section 6 of the Misuse of Drugs Act 1984.
Heraty faces three further charges from the same set of circumstances. He is charged with possession of cocaine, possession of cannabis, and possession of diamorphine. Those offences are contrary to Section 3 of the Misuse of Drugs Act 1977 as substituted by Section 6 of the Misuse of Drugs Act 1984.
Garda John McLoughlin of Ballyshannon Garda Station gave evidence of serving the defendant with the book of evidence ahead of his appearance in court.
Inspector Anthony Coyle told the court that the Director of Public Prosecutions (DPP) consented to the defendant being sent forward for trial to the next sitting of Donegal Circuit Court sitting in Letterkenny and commencing on December 9.
Judge Ciaran Liddy sent the defendant forward for trial on existing bail terms.
Legal aid was granted to solicitor Rory O’Brien and one barrister.
