A man told Naas District Court he has been arrested three times and never laid a finger on his wife.
He was before the court for an alleged contravention of a protection order in November 2021.
The court heard the couple have adult children.
Sgt Brian Jacob said the allegation was that he pushed his wife, putting her in fear.
However it was also stated that he merely put his hand on her.
The man said he no longer lives in the same house, having left almost a year previously.
Solicitor Seamus Boyle said the couple “won’t be seeing much of each other” because they have separated and divorce proceedings have been issued.
“They’ve gone their separate ways,” he said.
After applying the Probation Act, which means no conviction is recorded, Judge Desmond Zaidan was thanked by the defendant, who said “justice has at last prevailed.”
