A man who cut down a neighbour’s gate escaped conviction after paying €500 compensation.
Liam McNamara, 64, of Lea, Portarlington admitted cutting down a gate at Main Street, Ballybrittas on May 23 last year.
Sgt JJ Kirby said at 11.55am on the date the accused “used a consaw to cut down a gate” and when the injured party arrived they were chased back into their house. He said the man has no previous convictions.
Solicitor Josephine Fitzpatrick said her client “bought a tract of land through NAMA and understood he had a right of way.”
However, she said, “another neighbour erected a gate” before this incident occurred. She said her client had brought a letter of apology and €500 in compensation.
On hearing the sum had been paid, Judge Andrew Cody asked if there was animosity between the parties.
Ms Fitzpatrick said there was no trouble and they pass each other.
Judge Cody applied the probation act.
