A LIMERICK woman is facing arrest after creating a “health hazard” by illegally dumping a large amount of waste and rubbish in her own back garden.

A bench warrant was issued for the arrest of Megan Browne of Hyde Road, Ballinacurra Weston after she failed to appear before Limerick District Court last Friday.

She is being prosecuted by the local authority under the Waste Management Act 1996. Despite Ms Browne's non appearance in court, Judge John King decided to hear evidence relating to the offence.

A council official told the court Ms Browne’s letting agent notified the council, last year, that there was a large amount of waste dumped at the back of the rented property.

Having investigated the matter, Limerick City and County Council then issued Ms Browne with a statutory notice which required her to remove the waste.

The court heard that the pile of waste could be seen from a neighbouring house and that after scaling a ladder, the council official in question was able to photograph the waste.

This photograph was subsequently handed over to the judge for examination.

Judge King was also handed a letter from Ms Browne by a court official, to which he replied: “She’s only playing games”.

The court heard that whilst the pile of waste had “rotted down” over the past year, there is “still a considerable pile of rubbish” at the property.

Judge King described the waste as a “health hazard” adding that it has to be removed as a matter of urgency.

Solicitor Will Leahy, representing Limerick City and County Council, said a second prosecution would likely arise if Ms Browne doesn’t deal with the waste.

Having formally convicted Ms Browne, the judge issued a bench warrant for her arrest, in order to ensure she is present in court for her sentencing hearing.

The judge directed that he be notified and assigned to the case whenever the warrant is executed by Gardaí.
