The Unite trade union, which represents over 200 workers at the Cargotec (formerly Moffett Engineering) facility in Dundalk, yesterday announced that a ballot of members had returned a 93 per cent vote in favour of industrial action, starting with a one-day stoppage on 10th March.
The union says the dispute has arisen following what they say is the company’s refusal to engage meaningfully at the Workplace Relations Commission and the Labour Court regarding their proposal to transfer workers under what Unite describes as a ‘fake TUPE’, which they say could mean established jobs, pay and conditions could come under future attack.
Cargotec is a successful multinational, generating over €4 billion in revenue during 2022.
Also known as Cargotec Engineering Ireland Ltd, MOFFETT produces truck mounted forklifts sold under the same brand.
Invented in Ireland the MOFFETT name has become synonymous with truck-mounted forklifts in many parts of the world.
Commenting on the ballot result, Unite general secretary Sharon Graham said:
“Cargotec’s success is due to the commitment and expertise of its workforce in Dundalk and elsewhere.
“It has a responsibility to treat this workforce with dignity and respect.
“However, Unite members have well-founded concerns that the company is engaging in a ‘fake TUPE’ process.
“This union will not accept any attempt to undermine our members’ terms and conditions now or in the future.
“The Cargotec workers have Unite’s full and unstinting support in this battle to defend their jobs.”
Contacted for comment, the company issued a statement saying:
“We were informed through the media that strike action will be taking place at our factory in Dundalk in March.
“We await confirmation from Unite that this is the case and the reason for such action.
“We have recently completed a TUPE transfer which was carried out following a full consultation process, in addition to engagement with the WRC and the LRC.
“Unite was invited to participate in the process. During the consultation process, we duly notified, informed and consulted with employees and/or their representatives in advance of the transfer coming into effect.
“The transfer came into effect on 1st January 2023 whereby we transferred part of our business, namely the Fabrication and Paint Plant, to our global partner, FSP For Surface Protection. Under TUPE Regulations the employee’s terms and conditions, including pay, are fully protected.
“As a Company, we always abide by relevant legislation and we will continue to engage with our employees to build meaningful dialogue and address their concerns.”
