Derry Magistrate's Court was told today that the full file for three men charged in connection with the claim of responsibility for the shooting of Chief Inspector John Caldwell in Omagh on February 22 this year is not due until October.

William Martin McDonnell (36) of Balbane Pass, Caolan Robert Brogan (23) of Bluebell Hill Gardens and Tiernan McFadden (25) of Carnhill all in Derry are charged with one count of possessing a document for use in terrorism namely a claim of responsibility for the shooting on February 26.

The charge relates to the claim of responsibility by the New IRA for the shooting of the PSNI Chief Inspector in Omagh which appeared on a piece of paper stuck on a wall in Creggan.

At today's hearing solicitor for McDonnell and Brogan, Paddy MacDermott, said that this was a 'fairly recent matter'.

A prosecution barrister said that a full file on the case was not due until October 7 and asked for an adjournment.

All three are currently in custody and were not produced for today's hearing and the court was told that a High Court decision on bail applications by Brogan and McFadden was due tomorrow (Friday).

The defendant McDonnell had already applied to the High Court for bail and had been refused.

The case against the three men was adjourned until August 31.
