Derry man refused bail after alleged assault on 68-year-old father

Dylan Devine (30) of Brickfield Court in Derry was charged with assaulting his father and breaching a restraining order on May 10
A man has been remanded in custody at Derry Magistrate's Court today charged with assaulting his 68-year-old father.
Dylan Devine (30) of Brickfield Court in Derry was charged with assaulting his father and breaching a restraining order on May 10.
A police officer connected the accused to the charges and opposed bail.
The court was told that at 5.50pm on that date police received a 999 call from the defendant's father.
He said his son was on drugs and claimed he had raised his fists at him, had thrown a punch that missed and pushed a chair towards him.
The court also heard there was a live restraining order in place preventing Devine from harassing his father.
At interview Devine claimed he was unaware of the restraining order.
Bail was opposed due to the risk of reoffending as Devine was currently on a suspended sentence in relation to charges involving his father.
A police officer said that if there was any address it would have to be outside the city.
Defence solicitor Seamus Quigley said that this was not 'the easiest bail application'.
He said a number of addresses had been put forward and added that if there was a conviction an immediate custodial sentence would probably follow.
District Judge Suzanne Rice said the case was aggravated because it involved the 68-year-old father.
She said there had been 'a litany of call outs' in respect of Devine's behaviour towards his father.
She refused bail and remanded Devine in custody to appear again on May 21.
