Judge gives man who is facing explosives charges one chance after breaching bail

Gérard Kelly is currently on bail charged with explosives and grenades found in searches in Creggan in early September
A man currently on bail charged with explosives and grenades found in searches in Creggan in early September appeared at Derry Magistrate's Court today charged with breaching his bail.
Gérard Kelly (48) of Victoria Place in Derry was charged with breaching his curfew by not being at his place of residence when police called.
The court heard that the breach came about after Kelly had to go to hospital due to a self inflicted injury.
A police officer said that after receiving treatment Kelly did not return to his residence.
Defence counsel Stephen Mooney said his application was like something written by Hans Christian Anderson.
He said that the defendant said he had gone to the hospital and the police had taken a 'benign' view.
But after receiving some basic treatment the defendant had left due to the waiting time and walked back to his home.
He then claimed he had gone back to the hospital and that was why he was not present when police forced entry.
The barrister said that the explanation was 'so ridiculous there just might be some truth in it.'
District Judge Barney McElholm said he would give Kelly one chance this time and re-released him to appear again on November 2.
