Man charged with breaching restraining order and assault remanded

James Doherty (34) of no fixed abode was charged with assaulting a man occasioning him actual bodily harm on April 28 and attempted criminal damage to a door on the same date
A man subject to a restraining order preventing him from coming within 20 miles of the city has appeared at Derry Magistrates' Court charged with breaching the order and assault on a man.
James Doherty (34) of no fixed abode was charged with assaulting a man occasioning him actual bodily harm on April 28 and attempted criminal damage to a door on the same date.
A police officer connected the accused to the charges and opposed bail.
The court heard that there were three breaches of the order as well as the new charges.
It was said that two males approached a house and demanded entry.
They claimed that there was a sum of money in the house stating on one occasion there was £5,000 and on another that there was £10,000.
When the householder stopped them entering he alleged Doherty, who he knew, punched him on the side of the head causing a cut.
The man told police he believed that the two were under the influence of cocaine.
After the incident the two men apologised and asked the alleged victim not to phone the police and shook hands.
However, the court was told the two men returned a short time later with Doherty saying 'I want that money I will be back'.
Bail was opposed as Doherty has 32 previous convictions and there was a risk of reoffending.
Defence solicitor Paddy MacDermott said his client could be released to an address approved by the PSNI.
He said Doherty had issues and while in custody had seen a nurse on several occasions.
District Judge Ted Magill said that he did not believe Doherty would abide by bail.
Doherty was remanded in custody to appear again on July 10.
