A man who was just released from custody for assaulting his mother has appeared in Derry Magistrates Court charged with the same crime.

Dylan Smith, 30, of Lawrence Hill had been out of custody a short space of time when he was charged with an identical allegation.

Smith pleaded guilty to assaulting his mother on September 6.

The court heard that police were called to a domestic disturbance where Smith's mother accused him of punching her.

The court was told that he had a relevant previous record.

Defence solicitor Seamus Quigley said that, had his client pleaded differently, he may have been found not guilty.

He added that it should be to his credit that he pleaded guilty at the earliest opportunity and had faced up to the reality of the situation.

District Judge Barney McElhom said that Smith had 'quite a record of violence' and that this was one of the less serious incidents, but it was aggravated by the fact that it was domestic and sentenced Smith to three months.
