Book of Evidence served on defendant (51) over fatal collision that claimed the life of an elderly man in September 2024

A 51-year-old Inishowen man has been returned for trial in connection with a fatal road traffic collision in Clonmany almost two years ago.

Danny Hirrell, of Cloontagh, Clonmany, appeared before Carndonagh District Court for the service of the Book of Evidence. He is charged with careless driving, causing the death of Michael Toland.

A father and grandfather, Mr Toland, who was aged in his 80s, died at the scene after being struck by a van driven by Mr Hirrell at Annaugh, Clonmany, on September 18, 2024.

The defendant also faces a separate charge of being in possession of an unregistered vehicle, namely a UK-registered grey Ford Transit van, arising from the same incident.

Garda Tara McGrory told the court that she had served the Book of Evidence on Mr Hirrell at Buncrana Courthouse, where Carndonagh District Court continues to sit.

Sergeant Conor Mulkerns said the Director of Public Prosecutions has directed that the accused be sent forward for trial on the careless driving causing death charge. The case is due to be heard at the next sitting of Letterkenny Circuit Court, commencing on May 5.

Solicitor Ciaran Haran, appearing for Mr Hirrell, confirmed that his client would not be going forward to the Circuit Court on a signed guilty plea.

Judge Emile Daly noted that the Book of Evidence had been served and made an order returning Mr Hirrell for trial at Letterkenny Circuit Court. She also issued the standard alibi warning, requiring the accused to notify the State if he intends to rely on an alibi as part of his defence. A Section 56 order was also granted, directing that copies of all Garda interviews be provided to the defence.

Legal Aid was granted to Mr Haran for two counsel at the forthcoming Circuit Court trial, in light of the seriousness of the charge.

Mr Hirrell did not address the court during the brief hearing. He signed a bail bond before leaving and was remanded on continuing bail.

The separate summary charge relating to the alleged possession of an unregistered vehicle was adjourned until December 15, after an application by Mr Haran for a lengthy adjournment was granted.
