Castlederg man pleads guilty at Donegal District Court sitting

A Tyrone man was fined 250 after he pleaded guilty at Donegal District Court to an offence of holding a mobile phone whilst driving on the N15 near Donegal Town.

Calvin Kennedy, of 1 Edward Close, Castlederg, appeared before Judge Éiteáin Cunningham at Ballyshannon Courthouse.

Kennedy told the court he was not represented by a solicitor, and when asked if he would like a solicitor by Judge Cunningham, he replied: “No.”

When asked how he pleaded, Kennedy said: “Guilty.”

The charge was that on November 19, at the N15 in Drumlonagher, Donegal Town, while being the driver of a vehicle, he did hold a mobile phone, contrary to Section 3 (1) and (3) of the Road Traffic Act 2006.

Garda Sergeant Oliver Devaney told Judge Cunningham that Kennedy had been observed at 11.51am holding a mobile phone, and that he was stopped.

Kennedy then denied the option to address the court when asked if he would like to do so by Judge Cunningham.

Judge Cunningham convicted and fined Kennedy €250, which was to be payable within four months
