Alleged incident which caused another person bodily harm dates from July 2024

A case where it was alleged that a man dangerously drove his van, causing serious bodily harm to another person in Dunkineely has been adjourned until late September.

Gary Hegarty, 35, of Lennon View, Ramelton, appeared at Donegal District Court, held at Ballyshannon Courthouse, before Judge Éiteáin Cunningham.

It was alleged that on July 29, 2024, at Killaghtee, Dunkineely, he did drive a white Mercedes-Benz Sprinter van, in a manner (including speed) which having regard to all the circumstances of the case, was dangerous to the public, whereby it caused serious bodily harm to another person.

The alleged offence is contrary to Section 53(1) and 53(2)(a) (as substituted but Section 4(1) of the Road Traffic (No 2) Act 2011) of the Road Traffic Act 1961 (as amended by Section 5(k) of the Road Traffic and Roads Act 2023).

Garda Claire Ramsay told the court she had arrested Hegarty for the court’s sitting, and that he made no reply to the charge.

Sergeant Garda Oliver Devaney told the court that directions were for prosecution and indictment.

Judge Cunningham allowed bail for Hegarty, on the conditions that he resides at his current address and does not commit any offences.

She ordered that disclosure be directed to Hegarty’s solicitor and adjourned the case until September 28.
