Members of the Scottish Parliament’s Criminal Justice Committee have launched an investigation.

MSPs want to hear from victims of so-called “deepfake pornography” as they investigate whether existing laws are sufficient to deal with the problem.

Members of Holyrood’s Criminal Justice Committee are “deeply concerned” about the “rapid rise” in the creation of AI-generated images, saying it can cause “huge distress” to victims.

With technology increasingly being used to create fake intimate images and video, MSPs on the committee have launched a new inquiry to investigate the extent of the problem.

The committee is also considering the impact the creation of these “deepfakes” can have on victims – who are mainly women – and has appealed for anyone directly affected to contact them.

MSPs will consider if existing laws and powers to deal with the problem are adequate and how effectively offences can be prosecuted in practice.

Speaking as the inquiry was launched, convener David Linden said: “Our committee is deeply concerned by the rapid rise of non-consensual AI-generated intimate images and deepfake pornography which cause huge distress to victims.

“We want to hear directly from those who have been affected so that victims’ experiences are at the centre of our work.”

Mr Linden continued: “We will also consider whether existing laws and powers are adequate, and how effectively offences can be reported, investigated and prosecuted.

“AI image abuse and deepfakes can have a devastating impact on victims and are a growing form of technology-facilitated abuse.

“Evidence indicates that these harms disproportionately affect women and girls, but it can affect anyone, and the impact requires a strong response from the criminal justice system.

“Our committee is determined to find out what more can be done to support victims and ensure perpetrators face the consequences of their actions.”
