A Nenagh man has been given an eight-month prison sentence for a “serious and sustained assault” on a teenager.

Darvydas Cvekelis (21) of 8 Riverside Millersbrook was charged with assault causing harm to a minor on the Borrisokane Road, Nenagh on September 13, 2023.

Sergeant Regina McCarthy told Nenagh District Court that on September 14, 2023, the injured party and his mother came to Nenagh Garda Station to report the assault which had happened the day before.

The court heard that on the day of the incident, the defendant had approached the injured party on the Borrisokane road, shouting at him about his girlfriend.

The injured party crossed the road to avoid the defendant who followed him and shoved him against a wall.

The defendant then headbutted the injured party and took out his phone, began recording and demanded an apology.

The court heard that Mr Cvekelis told his victim that if he did not apologise he would give him another “box.”

The injured party complied and the defendant walked away.

The injured party’s mother picked him up and spoke with the defendant asking him to delete the video. She then took her son to Shannon Doc for treatment. Following the complaint, gardaí arrested Mr Cvekelis.

SPIRALLED

Acting for the defendant, solicitor John Spencer told the court that this incident was part of a “spate of offences” the defendant committed while under the influence of drugs and alcohol.

He said his client is 21 years of age and prior to this spate, had no previous convictions.

His issues with drugs and alcohol caused him to “spiral.”

Mr Spencer told the court that his client wishes to apologise to the injured party.  “The injured party was not seriously injured but it is a very serious matter and he wants to apologise.

“He has had time to consider things and for a man who had no previous convictions he now faces another 18 months,” said Mr Spencer.

He said his client is getting his Leaving Cert in prison and asked the judge not to add to his sentence.

However, Judge Fiona Brennan called the offence a “serious and sustained assault with the added issue of threats.”

She convicted the defendant and imposed an eight-month sentence starting the day of the court sitting.
