KILDARE: Allegedly published photograph of sleeping ex-partner’s bare breast on social media

SENT FORWARD FOR TRIAL
A man residing in County Kildare has been accused of publishing a photograph of his sleeping ex-partner’s bare breast on a social media site.
The accusations were heard during an in-camera (in private) court session held at Naas District Court on Thursday, October 19.
Judge Zaidan was told that the man stands accused of going up to his ex-partner, lifting up her shirt and exposing one of her breasts, and taking a photograph of it, all the while she was allegedly asleep.
It was also heard that the man allegedly stole a sum of money from the woman and allegedly breached a protection order, which was taken out against him by his ex-partner.
When gardaí told the judge that the couple have a child together, Judge Zaidan remarked: "Seriously... they have a child, and it is alleged that he posted this photo online?
"He's presumed innocent here, but their child could see it (the photograph) in the future."
After a book of evidence was served on the accused, Judge Zaidan sent the case forward to the present sittings of Naas Circuit Criminal Court.
He granted bail for the accused until the case resumes.
The judge also reminded the man that, as a part of the conditions of the present protection order, any communications between him and his ex-partner regarding their child 'must be civil.'
He adjourned the alleged breach offence to a date in February of next year for hearing, and warned the man that if he breaches the order again, that gardaí will re-enter the case against him at short notice.
