A man found driving while he was disqualified was prosecuted at Naas District Court.

Pawel Smagowski, 35, whose address was given as 16 Maplewood Way, Springfield, Tallaght, was prosecuted after being found driving with no licence a junction 8 on the M4 on July 19 last and with verbally abusing gardaí when he was stopped at Boycetown, Kilcock on August 16.

He appeared in court

Sgt Dave Hanrahan told the court the defendant failed to produce documents.

Sgt Hanrahan also said the defendant was disqualified from driving for ten years in June 2021.

The court further heard that the defendant has 17 previous convictions including 15 under the Road Traffic Act.

Defending solicitor Seamus Boyle said the defendant had mental health difficulties due to alcoholism and  he added the man was homeless for a number of months.

He also said that he was using the car to live in.

“His life was chaotic at the time (and) he’s getting help in prison,” added Mr Boyle.

He added the defendant had been living in Ireland for five years.

Judge Desmond Zaidan imposed a six months custody term and a six year disqualification for no driving licence and imposed a one month consecutive term for breaching the Public Order Act. An allegation of giving a false name and address was taken into consideration.

The custody terms were backed to take account of time spent in custody.
