A Porsche car parked on double yellow lines in Naas had no tax displayed, the insurance disc had expired and it had no NCT disc.

Before Naas District Court was Michael Leonard, 76, whose address was given as Tandy’s Bridge, Naas.

Garda Dylan Hogan said the vehicle was parked at Abbey Street, Naas on January 12, 2020. He said the tax had expired as had the insurance and there was no NCT.

He was looking at the 2007 car and the light started to flash and he was approached by the defendant who said documents would be produced.

The garda seized the vehicle and it was later reclaimed.

He added the defendant was pleasant to deal with.

He said the defendant admitted driving the car but it was owned by a relative.

“The owner was his son,” said the garda, adding that the defendant does not accept he was the owner.

Gda Hogan said he did not see the defendant park or drive the car.

Defending solicitor Tim Kennelly said the defendant was not the registered owner and he also said that the garda did not caution the defendant but information he gave was being used against him in the case.

Mr Kennelly said that the defendant admitted he had the car keys and not that he drove the car.

He said the defendant had no previous convictions.

Judge Desmond Zaidan said that the defendant was given every opportunity by the garda to produce documents and he believed that the garda had not made up his mind about the case at the time spoke to the defendant.

The judge said the absence of a caution did not render the prosecution’s case fatal.

Noting the defendant’s age and his very good record, Judge Zaidan applied the Probation Act.
