Pre-workout strike-out takes place in Kildare court
JUDGE'S DECISION
A Naas District Court judge struck out the case of a man accused of handling a stolen a pre-workout container.
Judge Desmond Zaidan was told by gardaí that the man had handled a container of Optimum Pre-Workout from a shop in County Kildare on April 1 last.
Upon being informed about the allegation, Judge Zaidan jokingly asked the man: "What about your post-workout? Or your in-between workout?" which drew some laughter from nearby court practitioners and a smile from the accused.
When defending barrister Donncha Craddock told the court that he had not received disclosure in the case from gardaí.
Garda Sergeant David Hanrahan also told Judge Zaidan that the prosecuting garda had not complied with the disclosure order.
Judge Zaidan decided to strike-out the matter without prejudice.
