A judge is to decide next month whether charges of assaulting and obstructing a garda, threatening and abusive behaviour and the alleged assault of a male levelled against a man following an incident in Ballymahon can be heard in the District Court.

Fabiano Moaias Sreitas (24), Tully House, Eyrecourt, Galway was remanded on continuing bail at last week's District Court sitting pending directions being received from the Director of Public Prosecutions (DPP).

Judge Bernandette Owens heard partial evidence which revealed the incident allegedly took place at Thomond Lodge, Ballymahon on November 6 last year.

However, because medical reports were not on hand to submit to the court, Judge Owens said she would not be in a position to deal with the question of jurisdiction at present.

Mr Moaias Sreitas was remanded on continuing bail to a sitting of Longford District Court on June 20.

It's expected that on that date Judge Owens will hear full evidence and determine if the case can be dealt with 'summarily' or sent foward to Longford Circuit Criminal Court.
