Defendant can avoid conviction by making a payment to St Christopher's Services, Longford
A defendant who felt “things got the better of her” was afforded the opportunity of avoiding a conviction by making a payment to St Christopher's Services in Longford.
Diane Penrose (41) of Rathbracken, Granard faced two counts of public intoxication. The defendant entered a plea of guilty to charges that on June 5, 2023 at Ballingall, Granard and November 28, 2023 at Greville Court, Granard she was intoxicated in public.
Sergeant Mark Mahon outlined details of both offences. Sgt Mahon said on Monday June 27 at 7:55 officers on patrol found the defendant in a highly intoxicated state. Ms Penrose was arrested own safety. An on spot fine was issued but not paid.
The offence from November saw officers encounter the defendant in a highly intoxicated condition. Ms Penrose was unable to stand up and again was arrested for her own safety.
Sg Mahon said the defendant had no previous conviction.
Solicitor Brid Mimnagh said the mother of three attended Cluain Mhuire for treatment in the aftermath of the offences.
“She is extremely embarrassed and annoyed by her behaviour,” Ms Mimnagh said. She explained to Judge Patricia Cronin that her client was working, but sustained an arm injury and is undergoing physiotherapy treatment.
“Things got the better of her. She has apologised profusely for her actions. Diane has been doing well since her treatment. She is now anxious to get back to work,” the solicitor said.
In noting that the defendant had not come to Garda attention, had no previous convictions and taking account of the mitigation put forward by the defendant's legal representative Judge Cronin said if Ms Penrose made a donation of €300 to St Christopher she could avoid convictions.
Judge Cronin concluded by saying: “If the charity donation is not forthcoming the defendant will receive convictions and two €150 fines.”
