Derry Court: Brothers charged with multiple driving offences

Two brothers have appeared at Derry Magistrate's Court today on driving charges.

Gavin Campbell (35) of no fixed abode was charged with allowing himself to be carried in a stolen vehicle on April 1.

His brother Wayne Campbell (39) of the Old Fort in Strathfoyle was charged with taking and driving away a vehicle, no insurance, driving with no insurance and with excess alcohol on April 1.

The court heard that police were on patrol and saw a vehicle that had been reported stolen.

The defendant Gavin Campbell was identified as being the front seat passenger and the driver was seen to be wearing a grey top.

The court was told that police lost sight of the vehicle for about 90 seconds before entering a retail park where they saw the defendants walking a dog.

The stolen vehicle was found 75 metres away and a key was found in the car park and handed in.

The defendants were stopped and arrested and Wayne Campbell failed a breath test and was found to be disqualified.

Wayne Campbell said his DNA would be in the vehicle as he had been in it before as it belonged to a relative of his brother's partner.

Bail was not opposed for Gavin Campbell as the reason he was in custody was due to a lack of address which was now available.

As regards Wayne Campbell the officer said he had 53 previous convictions 30 of them for traffic offences with 'quite a few' for driving while disqualified and dangerous driving.

The officer said there was'a very high risk' Campbell will drive if released.

Defence solicitor Paddy MacDermott said that there was now a suitable address for Gavin Campbell.

He said the case of Wayne Campbell was 'a bit more complicated' but asked for bail to an address approved by the PSNI.

Deputy District Judge John Rea released Gavin Campbell on bail on condition he does not travel as a front seat passenger in a vehicle.

As regards Wayne Campbell the judge said there was a 'circumstantial case' and he was not satisfied that conditions could manage the risk.

Wayne Campbell was remanded in custody to appear again on April 27.
