Maghera man jailed after breaching restraining order against his mother for fourth time

David Smith (36) of no fixed abode in Maghera was arrested on August 13 after police responded to a report of a domestic issue
A man has been jailed at Derry Magistrates Court after breaching a restraining order against his mother for the fourth time.
David Smith (36) of no fixed abode in Maghera was arrested on August 13 after police responded to a report of a domestic issue.
Upon arrival, police found Smith to be in breach of a restraining order that was in place until 2026.
His mother told police that she found him to be drunk when he arrived at the house in breach of the Restraining Order.
Smith had three prior restraining order breaches.
Defense solicitor Patrick McGuckin said that Smith was homeless and had pleaded guilty at the earliest opportunity.
He added that there had been no altercation and he had co-operated fully with police and claimed his mother had invited him to the house to get something to eat.
He was sentenced to four months in custody.
