Service of Book of Evidence to Donegal Town man scheduled for court date in January 2027

A Donegal Town man appeared before Ballyshannon District Court, charged with assault.

John McDonagh, 26, of Railway Park, Donegal Town, appeared before Judge Éiteáin Cunningham for an alleged offence that on October 14, 2025, at Railway Park, Donegal Town, he did assault a man, causing them harm, contrary to Section 3(1) and 3(2) of the Non-Fatal Offences Against the Person Act 1997 (as amended by Section 20 of the Criminal Justice (Miscellaneous Provisions Act 2023).

Gardaí told the Court that the defendant made no reply when cautioned, and Garda Sergeant Maurice Doyle said Gardaí had no objections to bail.

Bail was given to the defendant on a €200 bond, and on condition that he not commit any other offence, be of good behaviour, and have no contact with, through social media or otherwise, the alleged injured party or any witnesses.

Judge Cunningham heard that directions from the Office of the Director of Public Prosecutions (DPP) were to prosecute on indictment in the Circuit Court.

The case was adjourned until January 11, 2027, for the service of the book of evidence.

Judge Cunningham further directed disclosure to be sent to McDonagh’s solicitor.
