The man has been sent forward to the next sitting of Donegal Circuit Court
A man has been sent forward for trial for offences relating to regulations surrounding the transportation of fish.
The book of evidence was served on Daniel Melly of Roshine Road, Killybegs ahead of Monday’s sitting of Donegal District Court.
State solicitor Kieran Dillon told the court: “The Director [of Public Prosecutions] has directed that the defendant be sent forward for this offence on the evidence as set out in the book of evidence. She also consents to the accused being sent forward on a plea.”
Melly is being sent forward to the next sitting of Donegal Circuit Court sitting in Letterkenny, commencing December 5.
He is charged that on April 9, 2022, within the exclusive fishery limits of the state, he did not use the weights at the port of landing prior to transport to complete the transport documents. The offence is in contravention of Article 60(5) of Council Regulation (EC) No 1224/2009 and in contravention of Article 6 of Sea-Fisheries (Community Control System) Regulations 2016 Statutory Instrument No 54/2016 and is contrary to Section 14 of the Sea-Fisheries and Maritime Jurisdiction Act, 2006.
Judge Deirdre Gearty remanded the defendant on bail on his own bond of €100, on condition that he attend court proceedings as requested.
