Non-fatal strangulation charge being considered for Galway man in domestic violence case

He faces a further charge of breaching a protection order at University Hospital Galway
A charge of non-fatal strangulation is being considered against a man accused of assaulting his partner and later breaching a domestic violence order when the alleged victim was a hospital patient, a court has heard.
The 42-year-old man is charged that on August 17 at a location in Galway City, he assaulted a woman causing her harm, contrary to Section 3 of the Non-Fatal Offences Against the Person Act.
He is also charged with criminal damage and breaching a protection order, contrary to Section 33 of the Domestic Violence Act.
He faces a further charge of breaching a protection order at University Hospital Galway on August 22.
At Galway District Court this week, Garda Darren Hughes said a file is being prepared for the Director of Public Prosecutions (DPP).
He said there is a possibility that a charge of non-fatal strangulation may be brought against the accused.
Judge Tom MacSharry remanded the accused in custody to appear again in October 29.
Gardai objected to bail at the man's appearance before Galway District Court last month.
At the time, Garda Hughes said it is alleged on August 17 the man attempted to push the alleged victim into a fire and she suffered injuries as a result and had to be hospitalised.
It is further alleged the accused took the woman's jacket and threw it in the fire.
The court was told it is alleged that on August 22, the man came to University Hospital Galway and said to the woman, "You need to appreciate all I've done for you".
Barrister Donal Cronin (instructed by solicitor, Sarah Ryan) said his client is in a relationship with the alleged victim, and he is entitled to the presumption of innocence.
Counsel said he was not calling his client to give evidence, and suggested bail be granted subject to conditions.
At the time, Judge Gerard Furlong refused bail and outlined his reasons for doing so.
