Legal position of a disabled parking bay called into question at district court hearing

The case was heard in Kilmallock District Court and concerned a disabled parking bay
A LIMERICK man appeared before Kilmallock District Court for parking in a disabled bay without displaying a blue badge.
Gardaí on mobile patrol in Kilmallock on October 18, 2025, observed a car parked in a disabled parking space without a blue badge.
The court heard that a Fixed Charge Penalty Notice issued for the offence was not paid.
Taking to the witness stand, the defendant said that he had been given permission to use this space and that he had a letter from the council stating that the space was no longer designated for disabled parking.
He added that he gave a copy of this letter to Bruff garda station, as well as to the Fixed Charge Processing Office operated by An Garda Síochána in Thurles.
After reading the letter, Judge Patricia Harney noted: “This wasn't an official disabled parking bay, this spot was coloured in error.”
The case was dismissed on its merits.
